A recall election must be conducted using ranked-choice voting, Oakland City Attorney Barbara Parker wrote in an opinion issued Monday.

Parker's opinion lays out how a recall vote should operate in Oakland if a group seeking to recall Mayor Jean Quan collects enough signatures to qualify for the ballot. The candidates running to replace Quan would appear on the same ballot as the recall question, with voters asked to rank their top three choices, as they would in any municipal election.

There had been uncertainty over whether a recall ballot would use ranked-choice voting or operate under state rules, which don't allow voters to rank their top three candidates. Parker determined that the city's charter pertaining to ranked-choice voting prevailed over state rules.
